Guardianship and conservatorship services

If you have a disabled adult or minor child, you may be considering how you can protect and care for your loved one financially and physically for the rest of their life. Frails & Wilson attorneys can represent you in the probate court proceedings to set up a guardianship or a conservatorship.

Guardianships are more complete than conservatorships, generally. Guardianships are necessary when you are concerned about the welfare, both financial and physical, of your loved ones, such as an incapacitated adult (through any physical or mental condition) or a minor who lacks parents or the proper care of a family.

Conservatorships are a bit different. Rather than having control over every aspect of the incapacitated person, conservators have the power to receive, collect and make determinations about the property and finances of an incapacitated adult or a minor. This is a fiduciary role where the conservator manages the funds and property in the best interests of the incapacitated adult or minor, including education, welfare and safety, and must take note of the desires and values of the ward (the proper term for the incapacitated adult or minor).

Frails & Wilson provides advice on understanding your duties and responsibilities as a guardian or conservator and can assist in answering any questions that arise in this and other family law and estate planning situations.

A full-service family law practice

Although the firm’s family law practice focuses on adoptions, guardianships and conservatorships, it also offers a full range of other services, including representation in:

  • Divorce
  • Child custody and visitation
